Local contractor sued

A lawsuit was filed Monday in Monroe County Circuit Court against Dale R. Poetker as a registered agent of JLP Homes LLC for breach of warranty.

The filing alleges that homeowners Eric and Andrea Webb entered into a contract with Jon Poetker, owner of JLP Homes, for construction of a house on a vacant lot in Columbia in July 2015.

The filing also states the Webbs obtained a 10-year warranty protecting them against “any damage done to the property by reason of failure of a load bearing system,” among other stipulations.

Since construction of the home, the filing alleges the structure’s load bearing systems have failed and led to “permanent structural damage” to the siding, floors, concrete slabs, garage and walls.

The plaintiffs are seeking compensation for installation of a building stabilization system in the amount of $36,815 incurred due to the defendant allegedly refusing to honor the terms of the contract and warranty.

The filing also states additional repairs of at least $15,000 will be necessary, and they are seeking damages in excess of $50,000.
