Guilty plea in fatal boating incident

The criminal trial of Dylan T. McEwen, 26, of Swansea, in Camden County, Mo., has ended with a guilty plea to one count of boating while intoxicated.

The original charge filed in November 2021 against McEwen was BWI (death of another) – a Class C felony in Missouri. McEwen was charged after a boating incident at the Lake of the Ozarks on Aug. 8, 2021, claimed the life of 21-year-old Waterloo resident Sean P. Jouglard.

In pleading guilty to the lesser charge, McEwen was sentenced Thursday to two years of supervised probation and 48 hours of “shock incarceration” with Outreach Consulting and Counseling Services – Camden Office.

A wrongful death civil lawsuit filed by Jouglard’s family was settled in August 2022.

Court information stated that a missing person was reported before 6:30 p.m. Aug. 8 near the 20.1 mile marker of the Osage arm at the Lake of the Ozarks. The six people on the boat reported one of the occupants, Jouglard, was missing after the group went swimming.

Investigators asked those on the boat who was driving when Jouglard went missing, and they pointed to McEwen. A Missouri State Highway Patrol trooper reported he could smell alcohol on McEwen’s breath. A search warrant was obtained to get a chemical blood test for McEwen. A lab analysis of the blood was returned Sept. 2, indicating McEwen’s blood alcohol concentration was .187 percent three hours after the incident.

A video of the incident obtained by police showed Jouglard, a Gibault Catholic High School graduate, in the boat as it traveled over several wakes. On the last wake, Jouglard was thrown from the boat, court information states.

A witness also reported seeing a man fall off the boat, police said.

Jouglard’s body was recovered in the water on Aug. 9.
